Respondent Clark Oil & Refining Corporation operates a retail gasoline station in the city of Tomah. In 1962 the Tomah common council enacted an ordinance which forbade the parking of any vehicles utilized to transport gasoline, whether loaded or empty, on "any public street, highway or alley or open space" within the city limits and also prohibited the delivery of gasoline in vehicles with capacities of over 1,500 gallons to any premises excepting properly situated and authorized bulk tanks and railroad yards.
